Terms of service

Article 1 - Definitions
These terms and conditions include:
1. Withdrawal period: the period during which the consumer can use the right of withdrawal.
2. Consumer: the natural person who does not act in the course of a profession or business, and enters into a distance contract with ABOUT LIFESTYLE.
3. Business day: calendar day, Monday to Friday, excluding Dutch public holidays.
4. Duration transaction: a distance agreement for a range of products and/or services, where delivery and/or purchase is spread over time.
5. Right of withdrawal: the consumer's option to cancel the distance agreement within the withdrawal period.
6. ABOUT LIFESTYLE: the trading name of About Clercqstraat B.V., the company offering products and/or services to consumers.
7. ABOUT LIFESTYLE website: the online webshop of ABOUT LIFESTYLE at www.aboutlifestyle.nl.
8. Parties: the consumer and ABOUT LIFESTYLE together.

Article 3 - Applicability
1. These terms and conditions apply to any offer from ABOUT LIFESTYLE and to any agreement between ABOUT LIFESTYLE and the consumer.
2. Before the agreement is concluded, these terms and conditions are made available to the consumer. If this is not reasonably possible, ABOUT LIFESTYLE will indicate where the terms can be viewed and that they will be sent free of charge on request.
3. If specific product or service terms apply alongside these general terms, the consumer may always rely on whichever provision is most favourable in case of contradiction.

Article 4 - Offer
1. Products on the ABOUT LIFESTYLE website are described for general information only. Obvious errors or mistakes in the offer do not bind ABOUT LIFESTYLE.
2. ABOUT LIFESTYLE will indicate on the website when an offer has limited duration.
3. An offer is subject to availability. If a product turns out to be out of stock despite appearing on the website, ABOUT LIFESTYLE may cancel a confirmed order. The consumer will be informed by email and any payment will be refunded.

Article 5 - The agreement
1. The agreement takes effect once the consumer accepts the offer, subject to paragraph 4.
2. If the consumer accepts the offer through the website, ABOUT LIFESTYLE confirms receipt of the order by email without delay. The consumer may cancel the agreement until this confirmation has been sent.
3. ABOUT LIFESTYLE takes appropriate technical and organisational measures to secure data transfer and maintain a safe web environment, including for online payments.
4. Within legal limits, ABOUT LIFESTYLE may check whether the consumer can meet payment obligations. If this gives good grounds to refuse the agreement, ABOUT LIFESTYLE is entitled to decline the order.
5. ABOUT LIFESTYLE will provide the consumer, in writing or in an accessible and durable format, with: the address where complaints can be filed, the conditions and procedure for using the right of withdrawal (or a clear notice that it doesn't apply), and information on guarantees and after-sales service.
6. For an ongoing transaction, the previous paragraph applies only to the first delivery.

Article 6 - Right of withdrawal
1. When purchasing products, the consumer may withdraw from the purchase without giving a reason within 14 days of receiving the product.
2. During this period, the consumer will handle the product and packaging with care, only unpacking or using it as far as needed to assess whether to keep it. To exercise the right of withdrawal, the product is returned with all accessories and, where reasonably possible, in its original condition and packaging, following ABOUT LIFESTYLE's instructions.
3. If the consumer exercises the right of withdrawal, ABOUT LIFESTYLE will refund the amount paid, excluding delivery costs, within 7 days of the return being received in good order.
4. Delivery costs will not be refunded if the consumer chose a delivery method other than the standard option.

Article 7 - Exclusion of the right of withdrawal
1. ABOUT LIFESTYLE may exclude the right of withdrawal as described below, provided this is stated clearly in the offer, in good time before the agreement is concluded.
2. Exclusion is only possible for products that are made to the consumer's specifications, are clearly personal in nature, or cannot be returned by their nature.

Article 8 - Price
1. Prices of products and/or services will not increase during the validity of the offer, except for changes in VAT rates.
2. Price increases within 3 months of the agreement are only allowed if required by law.
3. Price increases after 3 months are only allowed if ABOUT LIFESTYLE has stated this in advance and either they result from statutory rules, or the consumer may cancel the agreement as of the date the increase takes effect. All prices include VAT.

Article 9 - Conformity and warranty
1. ABOUT LIFESTYLE ensures that products and/or services comply with the agreement, the stated specifications, reasonable requirements of usability, and the legal provisions in force on the date the agreement was concluded.
2. A guarantee provided by ABOUT LIFESTYLE, a manufacturer or an importer does not affect the consumer's legal rights under the agreement.

Article 10 - Delivery and execution
1. ABOUT LIFESTYLE takes the utmost care in receiving and executing product orders.
2. The place of delivery is the address the consumer has provided to ABOUT LIFESTYLE.
3. Accepted orders are carried out as quickly as possible, and no later than 30 days, unless a longer delivery period has been agreed. If delivery is delayed, or an order cannot be carried out in full, the consumer is informed within 30 days of placing the order and may cancel the agreement free of charge, with a right to compensation where applicable.
4. If the agreement is cancelled under the previous paragraph, ABOUT LIFESTYLE refunds the amount paid as soon as possible, and no later than 30 days after cancellation.
5. If delivery of an ordered product proves impossible, ABOUT LIFESTYLE will try to make a replacement item available, clearly indicating that a replacement is being delivered. The right of withdrawal continues to apply to replacement items, and the cost of any return shipping is covered by ABOUT LIFESTYLE.
6. The risk of damage to or loss of products rests with ABOUT LIFESTYLE until the moment of delivery to the consumer or an agreed representative, unless otherwise explicitly agreed.

Article 11 - Payment
1. ABOUT LIFESTYLE only accepts the payment methods indicated on the website, and may change these at any time. Actual payment costs are passed on to the consumer.
2. The consumer must promptly report any incorrect payment details to ABOUT LIFESTYLE.
3. In case of non-payment, ABOUT LIFESTYLE has the right to charge reasonable costs, within legal limits, after informing the consumer.

Article 12 - Complaints
1. Complaints about the performance of the agreement must be submitted to ABOUT LIFESTYLE fully and clearly, within a reasonable time after the consumer discovers the issue.
2. Complaints are answered within 14 days of submission. If a complaint needs more time, ABOUT LIFESTYLE will reply within 14 days indicating when a fuller response can be expected.
3. For a timely, valid complaint, the consumer is entitled to replacement or repair of the defective product, or an appropriate credit.
4. The consumer returns the defective product in full; return costs are for the consumer's account. The product becomes ABOUT LIFESTYLE's property once it has been replaced or credited.

Article 13 - Force majeure
1. If ABOUT LIFESTYLE cannot fulfil its obligations due to force majeure or default by one of its suppliers, those obligations are suspended for the duration of the event, without the consumer being entitled to compensation.
2. If the event of force majeure or supplier default lasts, or is reasonably expected to last, longer than three consecutive months, ABOUT LIFESTYLE may cancel the affected agreement without any liability to the consumer.

Article 14 - Disputes
Agreements between ABOUT LIFESTYLE and the consumer under these terms are governed exclusively by Dutch law.

Article 15 - Additional or differing provisions
Additional or differing provisions to these terms may not be to the consumer's detriment, and must be recorded in writing or in an accessible, durable format.
